Customer Services Agreement

This Customer Services Agreement is entered into by and between SwiftAutoPart , a company incorporated under the laws of Texas with its principal place of business at 10301 Northwest Freeway, STE 314, Houston, TX 77092, and the customer identified in the applicable order or invoice. This Agreement governs the sale of products and services provided by SwiftAutoPart .

1. Services Provided
​

 SwiftAutoPart provides auto parts, but not limited to the sale of OEM or aftermarket car parts, accessories, and components.All sales are subject to the terms and conditions outlined in this Agreement.

2. Payment Terms
​​

A –  Payment Methods: Payments can be made via credit card, debit card, PayPal, bank transfer, or other payment methods specified at checkout.

​

B – Payment Schedule: Full payment is due at the time of order placement unless otherwise agreed in writing.

​

C – Late Payment : Late payments may result in delayed order processing.

​

D – Currency: All prices are listed in USD, and payments must be made in USD.

​

E – Taxes and Fees: Applicable taxes, duties, and fees are the responsibility of the Customer and will be added to the total amount due.

3. Shipping and Delivery
​

A – SwiftAutoPart will make reasonable efforts to ship products within the estimated delivery time frame provided at the time of purchase. SwiftAutoPart is not liable for delays caused by external factors beyond its control.

B – Title and risk of loss for all products pass to the Customer upon delivery of the products to the shipping carrier.

 

4. Return and Refund Policy
​

A – Return Eligibility: Products must be returned in their original, unused condition, with all original packaging and labels intact. Returns must be initiated within 7 days of the delivery date .

B – Non-Returnable Items: Custom orders, special-order parts, electrical components, and items marked “final sale” are not eligible for returns.

C – Refund Process: Upon receipt and inspection of the returned items, SwiftAutoPart will issue a refund to the original payment method within 7-10 business days. Shipping and handling fees are non-refundable.

D – Restocking Fee: A restocking fee of 30% may apply to returns not due to an error by SwiftAutoPart.

E – Return Shipping Costs: Return shipping costs are the responsibility of the Customer, except in cases where the return is due to a defect or error by SwiftAutoPart .

5. Warranty
​

SwiftAutoPart provides a limited warranty on certain products as specified on the product page or accompanying documentation. This warranty does not cover normal wear and tear, misuse, or unauthorized modifications.

6. Limitation of Liability 
​

To the maximum extent permitted by law, SwiftAutoPart shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of its products or services. 

​

7. Governing Law 
​

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. 

​

8. Dispute Resolution 
​

Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in San Diego, California, in accordance with the rules of the American Arbitration Association.

9. Entire Agreement 
​

This Agreement constitutes the entire understanding between SwiftAutoPart and the Customer with respect to the subject matter here in and supersedes all prior agreements,representations, and understandings.

10. Amendments
​

SwiftAutoPart reserves the right to modify the terms of this Agreement at any time. Changes will be posted on our website and will become effective immediately upon posting .

IN WITNESS WHEREOF, the parties have executed this Agreement as of the date of the applicable order or invoice.
